Dubai: Who is Responsible for Property Maintenance—the Tenant or the Landlord?

As questions arise over maintenance responsibilities in Dubai, recent clarifications indicate that it is primarily the landlord’s duty to handle maintenance and repair work in rental properties.

This is outlined in Article 16 of Law No. 26 of 2007, which governs landlord-tenant relationships in the emirate.

According to the law, unless otherwise stipulated in the tenancy contract, landlords are responsible for all maintenance tasks that ensure tenants can fully utilize the property.

This includes rectifying any defects or damages that are due to circumstances beyond the control of the tenant.

Tenants are generally required to manage minor maintenance, such as changing light bulbs or fixing small leaks, but larger issues, including air conditioning repairs or significant damages, fall under the landlord’s obligations.

Article 17 of the Dubai Rent Law further supports this by stating that landlords are responsible for any modifications or issues that prevent the intended use of the property.

While tenants must pay rent promptly and care for the property, significant repairs or alterations typically require the landlord’s approval and relevant permits from official authorities.

In summary, unless specified in their rental agreement, tenants should not be responsible for major maintenance issues, reinforcing the landlord’s primary role in maintaining rental properties in Dubai.
